1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Levan Bakhia, operating as Wave Royale ("we," "us," or "our"), regarding your use of the Wave Royale mobile application (the "App").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Eligibility
To use the App, you must:
- Be at least 13 years old (or 16 in the European Economic Area)
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the App under applicable law
3. Account and Device Authentication
The App authenticates your device automatically using a unique device identifier stored in your device's Keychain. You are responsible for maintaining access to your device. We cannot recover accounts if you lose your device ID.
You may choose a username that is visible to other players. You agree not to choose usernames that are offensive, misleading, or infringe on the rights of others.
4. In-App Purchases
The App may offer in-app purchases through Apple's App Store. All purchases are subject to Apple's Terms and Conditions. We do not process payments directly.
- All in-app purchases are final and non-refundable except as required by law
- Refund requests should be directed to Apple through their standard process
- Virtual items and currency have no real-world monetary value
- Virtual items cannot be transferred, sold, or exchanged outside the App
5. Acceptable Use
You agree to use the App fairly and in accordance with these Terms. You agree NOT to:
- Use cheats, exploits, automation software, bots, hacks, or any unauthorized third-party software
- Modify or interfere with the App or its servers
- Exploit bugs or glitches for unfair advantage (please report them instead)
- Harass, abuse, or threaten other players
- Use offensive, discriminatory, or inappropriate usernames
- Attempt to gain unauthorized access to other players' accounts
- Reverse engineer, decompile, or disassemble the App
- Use the App for any illegal purpose
Important: Violation of these terms may result in immediate suspension or termination of your account without notice or refund.
6. Your Content
The only user-generated content in the App is your chosen username. You retain responsibility for your username and agree that it complies with our acceptable use policy. We reserve the right to change or remove usernames that violate these Terms.
7. Intellectual Property
The App, including its design, artwork, code, game mechanics, and all content, is owned by Wave Royale and protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment purposes in accordance with these Terms.
8. Service Availability
We strive to provide reliable service but cannot guarantee uninterrupted access. We may:
- Perform maintenance that temporarily affects availability
- Modify, update, or discontinue features with or without notice
- Reset game data or adjust balancing for fairness
- Suspend service due to security concerns or legal requirements
We are not liable for any unavailability or modifications to the App.
9. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, secure, or error-free
- Game balance will remain unchanged
- Any errors in the App will be corrected
- The App will be compatible with all devices
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAVE ROYALE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the App
- Any unauthorized access to our servers or your data
- Any interruption or cessation of the service
- Loss of virtual items, currency, or game progress
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify, defend, and hold harmless Wave Royale and its operator from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App or violation of these Terms.
13. Termination
Termination by You
You may stop using the App at any time by uninstalling it. To request data deletion, contact us at [email protected].
Termination by Us
We may suspend or terminate your access at any time for any reason, including violation of these Terms, cheating, or abusive behavior.
Effect of Termination
Upon termination, your access to the App and all virtual items, currency, and game progress will be revoked. You will not be entitled to any refund.
14. Dispute Resolution
Informal Resolution
Before filing a formal legal claim, you agree to first contact us at [email protected] to attempt to resolve the dispute informally.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Georgia, without regard to its conflict of law provisions.
Jurisdiction
Any dispute arising from these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through the courts of Tbilisi, Georgia.
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.
16. General Provisions
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Wave Royale regarding your use of the App.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
No Waiver
Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision.
Assignment
You may not assign your rights under these Terms without our prior written consent. We may assign our rights without your consent.
